They contend that legislation would provide a framework to protect these minority cultures and prevent the misuse or commercialization of their customs and practices. For instance, laws could be implemented to ensure proper attribution and acknowledgment of the origin of cultural ideas, as well as to prohibit offensive uses of cultural symbols or traditions.

On the other hand, opponents of legislating cultural appropriation argue that it is a form of expression and creativity that should not be restricted by law. They believe that censorship may infringe on freedom of speech and hinder cross-cultural understanding. Moreover, they contend that laws could potentially discriminate against certain groups and create divisiveness rather than promote harmony. For example, legislation might inadvertently favor specific cultural practices over others, leading to a perception of bias or unfair treatment.
